Welcome to Photo Album Buddy, a mobile application developed and operated by Wise Owl Solutions LLC (“we,” “us,” or “our”).

These Terms of Use (“Terms”) govern your access to and use of the Photo Album Buddy mobile app, website, and related services (collectively, the “Service”).
By downloading, accessing, or using Photo Album Buddy, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required by local law) to use Photo Album Buddy.
By using the Service, you represent that you meet this requirement and that all information you provide is accurate and complete.

2. Your Account

To use certain features, you may need to create an account.
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
You agree to notify us immediately at support@photoalbumbuddy.com if you suspect unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms.

3. User Content

a. Ownership

You retain full ownership of all photos, videos, and other content (“User Content”) you upload or share through the Service.
By uploading content, you grant Wise Owl Solutions LLC a limited, non-exclusive, worldwide, royalty-free license to:

Store, display, and process your content for the purpose of operating and improving the Service.
Display your content to others if you choose to share it publicly or with specific users.

This license ends when you delete your content or close your account.

b. Your Responsibilities

You agree that:

You have the necessary rights and permissions to upload and share your content.
Your content does not infringe on any third party’s rights (e.g., copyright, privacy, or trademark).
You will not upload or share any content that is unlawful, obscene, harmful, or otherwise violates these Terms or applicable laws.

We reserve the right (but are not obligated) to remove or restrict access to any content that violates these Terms.

4. Acceptable Use

You agree not to:

Use the Service for any illegal or unauthorized purpose.
Upload viruses, malware, or malicious code.
Attempt to hack, disrupt, or interfere with the Service or other users.
Use automated systems (e.g., bots, scrapers) to access the Service.
Impersonate another person or misrepresent your identity.

Violation of these rules may result in suspension or termination of your account.

5. Intellectual Property

All intellectual property rights in the App, including its design, features, logos, and trademarks, are owned by Wise Owl Solutions LLC or its licensors.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

6. In-App Purchases and Subscriptions (if applicable)

If the App offers paid features or subscriptions:

Payments are processed through the Google Play Store, Apple App Store, or Stripe.
All purchases are subject to the store’s payment terms and refund policies.
Subscription renewals will be automatic unless canceled before the renewal date.

We do not store or process your payment information directly.

7. Termination

We may suspend or terminate your account or access to the Service at any time, with or without notice, if:

You violate these Terms.
You engage in fraudulent, abusive, or harmful behavior.
We discontinue the Service.

Upon termination, your right to use the Service will immediately end, and we may delete your data in accordance with our Privacy Policy.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
We do not guarantee that:

The Service will be uninterrupted, secure, or error-free.
Your content will not be lost or corrupted (we recommend keeping backups).
The Service will meet your expectations.

To the fullest extent permitted by law, Wise Owl Solutions LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Wise Owl Solutions LLC, its affiliates, and its employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid (if any) to use the Service in the 12 months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Wise Owl Solutions LLC and its affiliates from any claims, damages, liabilities, and expenses (including legal fees) arising from:

Your use of the Service.
Your violation of these Terms.
Your infringement of any third-party rights.

11. Changes to These Terms

We may update these Terms from time to time.
When we do, we will update the “Last updated” date at the top of this page.
Continued use of the Service after changes means you accept the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.
Any disputes shall be resolved exclusively in the courts located in Lubbock, Texas.
